Salman Khan's hit-and-run case- Court orders fresh trial

It will indeed be a happy birthday for Salman this December. The macho actor who has always had court cases dangling above his head like the Damocles sword finally got a big breather yesterday when Sessions Court ordered a fresh trial in the infamous hit-and-run case. This effectively means all the witness and evidence will be reexamined and reproduced. Salman's lawyer Shrikant Shivade had argued that the evidence produced before the magistrate's court should be discarded since Salman would face a serious charge. He also stated that Salman’s defense had not been given an opportunity to cross-examine the witnesses on the far more graver charge of culpable homicide not amounting to murder. The prosecution, however opposed the plea for a fresh trial, terming it a delaying tactic. Sessions Court Judge DW Deshpande accepted Salman's plea for a retrial and ordered for the trial to start on December 23. Salman was previously charged and tried by a magistrate's court under Section 304(A) (rash and negligent driving). He was later however chargesheeted under 304(2) which meant he could spend 10 years behind bars if found guilty. Now with the court ordering a fresh trial it would effectively end up delaying the already delayed case. Let's wait and watch how the trial proceeds on 23 December.
