Showik Chakraborty applies for fresh bail

MUMBAI: During the investigation of SSR's death, the drug nexus in Bollywood was exposed, and many big names came out of this case, which shocked the nation.

Rhea and her brother were taken for interrogation where Showik had confessed that he was procuring and consuming drugs on the behest of Rhea.

Both were arrested under the NDPS act and were sent to jail for almost a month. the Bombay High Court has granted Rhea bail on the basis of lack of evidence.

Only one or two chats proved that she was speaking about drugs, and not much proof exists to prove that she was procuring or consuming drugs.

On the other hand, her brother Showik’s bail has been rejected as there is a lot of evidence proving that he was into procuring and consuming drugs.

In light of the Supreme Court’s ruling last month, which held that statements made before NCB officers cannot be considered as confessions, Showik’s legal counsel has cited that there is no reason to keep the 24-year-old behind bars.

Since Showik was arrested on 4th September 2020, he was denied bail by the session and high court.  His lawyer also pointed out the fact that no drug was recovered from Showik’s possession and that NCB’s only evidence was the statements of the co-accused.

As per Times of India, Showik has applied for a fresh Bail plea once again and his lawyer is trying his best to bring him out.

The plea stated that Showik’s statements cannot now be used as evidence after the SC ruled that NCB officers are to be considered as “police officers.

Reports further went on to state that all statements recorded by the NCB, under Section 67 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act cannot be considered confessions.

In the application, Showik reiterated that he has been falsely implicated in the case.

The accused has been booked under section 27(A) mechanically and without application of mind, it said.

It alleged that the probe agency spun a false narrative that portrays Showik as being someone who finances and procures drugs.

The matter is likely to be heard next week concluded by his lawyer. Now whether Showik will ger bail or no one would have to wait and watch, as of now Rhea is roaming like a free bird.
